These General Terms of Use (hereinafter the “CGU”) govern access to and use of the KRUZ website (hereinafter the “Site”), published by the company whose full contact details appear on the “Legal Notice” page accessible on the Site. Any user of the Site is invited to read these CGU carefully.
Purpose and scope
These CGU are intended to define the conditions under which KRUZ makes the Site available to any person (hereinafter the “User”) and the rules that the User undertakes to comply with when browsing and using the services offered on the Site.
They apply to any use of the Site, regardless of the means of access (computer, mobile, tablet, etc.). The complete identity of the Site publisher is available at any time on the “Legal Notice” page.
Acceptance of the CGU
Access to and use of the Site imply the User’s unreserved acceptance of these CGU in the version in force at the time of connection.
If the User does not agree to any of the stipulations, they are requested not to use the Site. Acceptance is deemed given upon first browsing the Site.
Access to the Site and availability
KRUZ endeavours to keep the Site accessible 24 hours a day, 7 days a week, except in cases of force majeure or events beyond its control, and subject to maintenance, corrective or upgrade operations, which may be carried out without prior notice.
KRUZ shall not be held liable for any interruptions, suspensions or failures of the Site, whatever the cause, nor for any consequences that may arise for the User or third parties.
The connection costs and computer equipment necessary to access the Site remain the sole responsibility of the User.
Intellectual property
All elements making up the Site (texts, graphics, logos, images, videos, source code, databases, domain name, etc.) as well as the “KRUZ” trademark are protected by Belgian and international intellectual property legislation. They are the exclusive property of KRUZ or its partners, where applicable.
Any reproduction, representation, adaptation, translation, modification, dissemination, in whole or in part, of the content of the Site, by any means whatsoever, without the prior written authorisation of KRUZ, is strictly prohibited and may constitute an infringement giving rise to liability before the Belgian courts.
Trademarks and logos appearing on the Site are the property of KRUZ or of third parties that have authorised it to use them. No right or licence is granted in respect of these elements beyond mere browsing of the Site.
Authorised use and prohibited conduct
The User undertakes to use the Site in compliance with public policy, good morals and the laws and regulations in force. In particular, the User shall refrain from infringing the rights of KRUZ or third parties, hindering the proper functioning of the Site, altering its content, or introducing harmful data (viruses, malware, etc.) into it.
In particular, it is prohibited to extract, by scraping or any other unauthorised means, data from the Site, or to use the Site for fraudulent, illegal or commercial purposes without the prior agreement of KRUZ.
KRUZ reserves the right to suspend or block access to the Site of any User who fails to comply with these stipulations, without prior notice or compensation.
Hyperlinks and third-party sites
The Site may contain hyperlinks redirecting to websites or applications published by third parties. KRUZ exercises no control over these external resources and disclaims all liability for their content, accuracy, legal compliance or data protection policy.
The insertion of hyperlinks pointing to the Site is authorised provided that the technique of “deep linking” which would allow a page of the Site to be displayed within another website is not used, without the express authorisation of KRUZ. Any link must clearly indicate that the content originates from KRUZ.
Personal data and cookies
In the context of using the Site, KRUZ may collect and process personal data concerning the User, in accordance with the General Data Protection Regulation (GDPR) and the applicable Belgian legislation.
The collection methods, categories of data, purposes, the User’s rights and information concerning cookies are detailed in the Privacy Policy and the Cookie Policy, available at all times on the Site. The User is invited to read them before browsing.
Liability and warranties
The Site is provided “as is” and without warranty of any kind, express or implied. KRUZ does not guarantee that the Site is free from errors, bugs, interruptions, or that it perfectly meets the User’s expectations.
Within the limits set by mandatory Belgian law, KRUZ shall not be liable for any direct or indirect, material or immaterial, foreseeable or unforeseeable damages arising from the use or inability to use the Site, including in the event of loss of data, loss of revenue, damage to image or any other loss.
KRUZ cannot be held liable for content posted by Users on the Site, where applicable, nor for the conduct of other Users. The User is solely responsible for the use they make of the Site and the information they consult on it.
Force majeure
Neither party shall be held liable for any non-performance or delay in performance of its obligations resulting from a force majeure event as generally recognised by Belgian case law, including natural disaster, fire, strike, failure of telecommunication networks, governmental decision, pandemic, or any other event beyond its reasonable control.
Upon the occurrence of such an event, the respective obligations are suspended. If the impediment persists beyond a reasonable period, KRUZ may, at its discretion, suspend or interrupt access to the Site without its liability being incurred.
Amendment of the CGU
KRUZ reserves the right to unilaterally amend these CGU at any time. The applicable version is that in force on the date the User connects, accessible on the Site.
It is the User’s responsibility to consult the CGU regularly in order to be aware of any amendments. Continued use of the Site after the CGU have been updated constitutes acceptance of the amendments.
Applicable law and competent jurisdiction
These CGU are governed by Belgian law. Any dispute arising in connection with their interpretation, validity or performance shall fall within the exclusive jurisdiction of the courts of the judicial district of Brussels, notwithstanding any contrary jurisdiction clause and subject to the mandatory provisions of the Belgian Judicial Code or consumer law, where applicable.
